Lease assignment

By giving tenants the right to assign their lease agreement, they can leave their apartment before the lease ends without carrying the financial burden of paying two rents at the same time. However, currently a tenant can “force” a lease assignment. Some tenants have even sold their leases for profit. There would then be no prejudice if, when a tenant tells a landlord that he wants to assign his lease, the landlord had the choice to free the tenant of all obligations.

The property owner could then re-rent the unit himself or keep it unoccupied to do renovations before re-renting it. CORPIQ would like changes to be made to article 1871 of the Civil Code of Quebec.
