Clauses banning animals are valid

On two separate occasions in 2015, the Minister responsible for the Régie du logement, Pierre Moreau, reiterated that “freedom of contract between landlords and tenants takes precedence. Therefore, the landlord has the right to decide whether or not to allow the presence of animals, according to the particular characteristics of the building and environment.”

This clarification was made following CORPIQ’s statement on the SPCA’s petitions to stop landlords from prohibiting animals in leases. During a parliamentary committee on animal welfare (Bill 54), CORPIQ asked that the law be clarified because some administrators at the Régie du logement had been trying to rule clauses banning animals invalid, even though most case-law says otherwise and confirms that they are legal.
