Starting Wednesday, October 17th, Quebec property owners who wish to prohibit the smoking of cannabis in their dwellings will have until January 15, 2019, a total of 90 days, to send the notice of modification to the lease prepared by CORPIQ. This prohibition will also apply to land, balconies, terraces and common areas.

The tenant cannot reject this amendment, unless he has a prescription authorizing him to consume cannabis for medical purposes. In this case, he must notify his owner of his refusal within 30 days of receiving the notice of change. If the property owner does not believe this reason for refusal, he may submit an application to the Régie du logement, who will decide whether or not the tenant's refusal for medical reasons is justified.

In addition, according to the Cannabis Regulation Act (Quebec law), home-growing for personal use is forbidden, under penalty of a fine ranging from 250 $ to 750 $. Anyone growing five or more plants at home commits a criminal offense under federal law.

According to a CORPIQ survey conducted last June, no less than 86% of responding property owners with one or more leases permitting smoking intend to take advantage of the 90 day period to send tenants the notice of modification to the lease indicating that smoking cannabis in their building will remain banned.
